1. Acceptance of Terms
Welcome to Perfume Bazar. By accessing or using our website, mobile application, or services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).
If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Perfume Bazar LLC.
By using Perfume Bazar, you affirm that you are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
2. User Accounts
To access certain features of the Service, you must register for an account. You agree to:
- Accurate Information: Provide accurate, current, and complete information during the registration process and keep it updated.
- Security: Safeguard your password and take full responsibility for all activities that occur under your account.
- Notification: Immediately notify us of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.
3. Marketplace Services
Perfume Bazar provides a platform for users to buy, sell, and exchange fragrances. We are not a party to any transaction between buyers and sellers, although we facilitate the transaction.
Our Role
We act as an intermediary platform. We do not manufacture, store, or inspect the items sold by users unless explicitly stated otherwise for verification services.
User Responsibility
Users are solely responsible for their interactions with other users, including the quality, safety, and legality of items advertised.
4. Buying and Selling
4.1 For Sellers
- Listing Accuracy: You must accurately describe your item, including its condition, authenticity, and fill level. Photos must be of the actual item.
- Authenticity: You warrant that all items listed are authentic. Selling counterfeits, testers labeled “not for sale,” or decants where prohibited is strictly forbidden.
- Fulfillment: You must ship sold items within 3 business days of purchase confirmation and provide valid tracking information.
4.2 For Buyers
- Commitment to Buy: When you purchase an item, you are legally obligated to complete the transaction.
- Payment: You agree to pay the total price including item cost, shipping fees, and applicable taxes.
- Inspection: You should inspect items promptly upon receipt and report any issues within 48 hours.
5. Prohibited Items & Activities
The following items and activities are strictly prohibited on Perfume Bazar:
- Counterfeit or replica fragrances
- Stolen goods
- Items that present a health or safety hazard
- Empty bottles (unless clearly categorized)
- Off-platform transactions to avoid fees
- Harassment or abusive language
- Data scraping or mining
- Creating multiple accounts to manipulate prices
6. Fees and Payments
We charge fees for the use of our platform to cover operating costs and payment processing.

Fees are deducted automatically from the payout. Prices for items are listed in USD. You are responsible for any applicable taxes.
7. Shipping and Delivery
Shipping is handled by the seller or through our integrated shipping partners.
- Responsibility: Sellers are responsible for proper packaging to prevent breakage (specifically for glass bottles).
- Tracking: Valid tracking numbers must be provided for all orders. Funds are held until delivery is confirmed.
- Hazardous Materials: Perfumes often contain alcohol and are considered hazardous materials (HazMat). Sellers must comply with all carrier regulations regarding the shipment of such items.
8. Returns and Refunds
All sales are generally final. However, buyers are protected under our “Authenticity & Description Guarantee.”
Refund Eligibility
A buyer may return an item for a full refund if:
- The item is counterfeit.
- The item is significantly not as described (e.g., wrong brand, broken bottle, completely different fill level).
- The item never arrived (lost in transit).
Note: We do not accept returns for “smell dislikes” or “change of mind” given the personal nature of fragrances.
9. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Perfume Bazar and its licensors.
Users retain ownership of the content they post (e.g., photos, reviews) but grant Perfume Bazar a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Service.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
11. Disclaimers & Liability
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
Limitation of Liability
In no event shall Perfume Bazar, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
12. Indemnification
You agree to defend, indemnify and hold harmless Perfume Bazar and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of New York, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
